This paper presents and examines the theory of common ownership of the earth articulated and defended by Mathias Risse, focusing on the case of immigration. We argue that this theory has serious difficulties, both immanent and with regard to its consequences, and accordantly it cannot take charge of the migratory flows that go back to the economic inequality in terms of justice. Finally, as an alternative to this proposal, a defense of open borders based on a global luck egalitarian conception is presented.
