In recent years, the creative industry has become important for the world economy; due to this, various countries have begun to analyze, distinguish and direct public policies to strengthen the cultural and creative industries; as well as, provide them with legal support and legal protection from Intellectual Property. In view of this, the article presents the concepts of culture, cultural industry, creative industry, public policies, and cultural public policies; likewise, a comparison is made between the treatment of the cultural and creative industries at the level of public policies and legal accompaniment/protection at the level of intellectual property in Peru and countries that are inside and outside the South American region. It is noted that the creative and cultural industries in Peru are treated jointly and have a greater incidence in the cultural industries; which determines that it is relegated in relation to the advances in the strengthening and promotion of the creative industries around the world. Consequently, the implementation of an exclusive public policy for the creative industries that include intellectual property as an important pillar of its strengthening and promotion is suggested.
